Applicants must hold a recognized Master's degree (or equivalent), have a solid background in the theory and methods of their field, and demonstrate good knowledge of English. Employed PhD candidates typically have an employment contract and complete their dissertation within three to four years.

Non-employed PhD researchers are not currently charged tuition by Tilburg Law School. Employed PhD candidates have employment contracts and are paid a salary. Scholarships for non-employed PhD candidates may come from foreign governments, international organizations, or Dutch funds.
